One of the ways to dispose of such property is the transfer of all rights to it under the exclusive rights alienation agreement.
The alienation agreement shall be made in writing. Failure to made it in the written form results in invalidity of the alienation agreement.
Transfer of the right to intellectual property must be registered by the Rospatent’s Federal Institute of Industrial Property (FIPS) in cases provided by law. If the right is not registered, its transfer under the alienation agreement made by the parties will be invalid.
The registration process in FIPS takes approximately two months from the date of filing the relevant documents. Upon its completion, the right holder is granted the Annex to the certificate or patent attesting the transfer of the right.
